UPDATE: Water Control and Improvement District No. 3

WCID No. 3 Update 


At the March 26, 2019 Boerne City Council meeting, the Council received an update on WCID No. 3.

The legal issues surrounding the WCID No. 3 are complex and the City is following the process set out in Senate Bill 914 passed June 2017. Senate Bill 914 requires WCID No. 3 to get the City’s consent to formation. The City has not consented to formation of WCID No. 3 and has not acknowledged the creation of WCID No. 3. The City is considering all factors involved with WCID No. 3 including the following:

  • Boerne West development is approximately 332 acres of WCID No. 3 located off Scenic Loop Road and Corley Road owned by Boernebak, LLC. The proposed development could have approximately 1100 homes and will be provided with water service by San Antonio Water Systems (SAWS). No sewer service has been finalized to our knowledge.
  • The majority of land in the WCID No. 3, approximately 680 acres, is actually owned by LTB Interests, LTD.  There is no development agreement or discussion of a development agreement between the City and LTB Interests, LTD.
  • The City is being proactive and has engaged Kendall County, Boerne ISD, and Cow Creek Groundwater Conservation District to obtain input on the impacts that WCID No. 3 would have on Boerne, the County, Boerne ISD, and the community as whole.
  • These concerns as to the ownership and development prospects of the entire 1012 acres of WCID No. 3 are being considered prior to the City moving forward with any development agreements. If the City were to consent to WCID No. 3, without addressing the development concerns of the entire 1012 acres, the City would have no ability to regulate the impacts of the of the additional 680 acres that are not part of any development agreement currently being negotiated. The City is being proactive and looking at the big picture impact of the entire 1012 acres of proposed development in WCID No. 3. The City wants to responsibility regulate the impacts then entire 1012 acre WCID No. 3 would have on the community as a whole.
  • The City has maintained communication regarding these concerns about WCID No. 3 with Senator Donna Campbell’s and Representative Kyle Biedermann’s offices.
