Boerne Police Department Racial Profiling
Texas SB 1074, which became law on September 1, 2001, prohibits racial profiling by Texas peace officers. Texas HB 3389 became effective September 1, 2009 and required agencies to collect stop data beginning on January 1, 2010.
Article 3.05 of the Texas Code of Criminal Procedure defines Racial Profiling as: "A law enforcement-initiated action based on the individual's race, ethnicity, or national origin rather than on the individual's behavior or on information identifying the individual as having engaged in criminal activity."
The chief administrator of the agency, regardless of whether the administrator is elected, employed, or appointed, is required to submit an annual report of the racial profiling information collected under Subdivision (6) of the Texas Code of Criminal Procedure to:
- The Commission on Law Enforcement Officer Standards and Education
- The governing body of each county or municipality served by the agency, if the agency is an agency of a county, municipality, or other political subdivision of the state
